1. General Provisions
This website (the “Site”) is operated by Biosmyrna Gıda Sanayi ve Ticaret A.Ş. (“Biosmyrna”).

Anyone who accesses the Site, uses the Site or makes use of the content offered on the Site is deemed to have accepted these Terms of Use. You are advised to read these terms carefully before using the Site. If you do not accept these terms, you should not use the Site.
2. Purpose of the Site
The Site has been created to provide information about Biosmyrna’s activities, product groups, sourcing and trade activities, quality and assurance approach, production activities, sustainability work, corporate structure, contact channels and sector information content.
No online sales are made through the Site.
Online sales of Bioyem products are conducted through the Bioyem brand’s own website (bioyem.com) and under that site’s own terms.
Unless expressly stated otherwise, information on the Site relating to products, services, capacity, technical specifications, certificates, sourcing possibilities, delivery, commercial terms or similar matters does not, on its own, constitute an offer for sale, a binding commercial commitment or a contract.
Where a separate quotation, order, contract or other commercial document is issued between the parties for a specific commercial transaction, the provisions of those documents apply to that transaction.
3. Use of Site Content
The texts, photographs, images, graphics, logos, trademarks and signs, technical information, product descriptions, documents, Knowledge Centre content, design and user interface, and all other content and materials on the Site may belong to Biosmyrna or to the relevant right holder and may be protected under intellectual property legislation.
Site content may be viewed only for personal and lawful use.
Without the written permission of Biosmyrna or the relevant right holder, the following uses of Site content are prohibited:
- reproduction for commercial purposes,
- copying,
- distribution,
- publication,
- modification,
- republication,
- use on another website or digital platform,
- use in the promotion of products, services or commercial activities.
This provision does not remove the rights of use and quotation permitted by law.
4. Trademarks and Other Intellectual Property Rights
The Biosmyrna name, logo, brand elements, design elements and other distinctive signs on the Site may belong to Biosmyrna or to the relevant right holders. These elements may not be used without express written permission.
For content in which Biosmyrna does not hold intellectual property rights, the rights of the relevant right holders are reserved.
The relevant intellectual property rights are also reserved with respect to the Bioyem brand and the brand, logo, product and design elements belonging to Bioyem.
5. Product and Technical Information
The product and technical information on the Site is provided to help users obtain general information about Biosmyrna’s product groups and activities.
Product specifications, analysis values, certification information, packaging options, quantities, sourcing terms, delivery conditions and similar information may change depending on time, product, lot, country, legislation and commercial terms.
It should therefore be separately confirmed that the information on the Site is current and binding for a specific commercial transaction. Technical or analytical values in particular should be confirmed with the lot-based analyses or technical documents of the product concerned.
6. Information on Organic Products
Within the scope of Biosmyrna’s activities, organic products may be sourced, traded or processed within the framework of the relevant legislation and certification systems.
The description of a product as “organic” on the Site is based on the nature of the product concerned and on valid certification/conformity documents.
Information on organic production, certification and product status should be assessed together with the relevant legislation and the records and documents of the authorised control/certification bodies.
Biosmyrna attaches importance to informing users correctly that expressions such as “natural” or similar do not, on their own, mean official organic certification.
7. Currency of Site Content
Biosmyrna makes reasonable efforts to keep the information on the Site accurate, current and usable. However, product information, sourcing status, certificates, regulatory information, technical information, contact details, commercial terms and other content may change over time.
To the extent permitted by law, Biosmyrna cannot be held responsible for consequences that may arise from information on the Site being out of date or having changed.
Where any information on the Site is relied upon for a specific commercial transaction, that information must be separately confirmed with Biosmyrna.
8. Knowledge Centre and Sector Content
The Blog, Technical Information, Frequently Asked Questions and other Knowledge Centre content on the Site has been prepared for general information purposes.
This content does not constitute:
- legal advice,
- financial or accounting advice,
- veterinary services,
- agricultural engineering advice,
- feed formulation or animal nutrition advice,
- an official regulatory opinion,
- professional technical advice.
When making decisions about their own activities, users should separately consider the relevant legislation, current official sources and, where necessary, the opinions of competent professionals.
9. External Links
The Site contains links to third-party websites that are not operated by Biosmyrna. These belong to Biosmyrna’s social media accounts and content sharing links.
In addition, the map area on the Contact page links to Google Maps, and the “Online Shopping” link on the Bioyem pages links to the Bioyem brand’s own website (bioyem.com). These sites are subject to their own terms of use and privacy terms.
These links are provided solely for information and convenience and work only when the user clicks them.
The content, security, accessibility, privacy practices or terms of use of third-party websites are not under Biosmyrna’s control. If you visit a third-party site, that site’s own terms of use and privacy policies apply.
10. Content Provided by Users
The areas of the Site through which users can submit content are the quotation form, the call-back form and the job application form. The Site has no membership, comment, forum or general file sharing features.
Content submitted through these areas must be lawful. The user must not:
- unlawfully share personal data belonging to others,
- submit content that infringes copyright or other intellectual property rights,
- submit unlawful, threatening, insulting or abusive content,
- submit files or content that could constitute malware or a security threat,
- provide misleading or false information.
11. Prohibited Uses
The Site may not be used for the following purposes:
- engaging in unlawful activities,
- attempting to damage the Site or the Site infrastructure,
- attempting unauthorised access,
- attempting to circumvent the Site’s security mechanisms,
- overloading the Site infrastructure or servers,
- sending malware or malicious code,
- collecting or copying Site content by automated means without permission,
- attempting to gain unauthorised access to other people’s personal data,
- infringing the intellectual property rights of Biosmyrna or third parties,
- using the Site for misleading, fraudulent or unlawful purposes.
Biosmyrna reserves the right to take the necessary technical and legal measures when unlawful use or use that threatens security is detected.
12. Site Security and Access
Biosmyrna endeavours to take reasonable technical and administrative measures for the Site to operate securely, without interruption and without errors. Forgery protection and multi-layered checks against automated bot submissions are applied to form submissions.
However, due to the nature of internet and electronic communication infrastructures, the following cannot be guaranteed:
- uninterrupted access,
- error-free operation,
- complete prevention of all security threats,
- content always being complete or up to date.
Biosmyrna may temporarily suspend or restrict access to all or part of the Site for maintenance, updates, technical failures, security incidents or other reasonable reasons.
13. Protection of Personal Data
The principles for processing personal data in connection with the use of the Site are explained in Biosmyrna’s relevant personal data texts. In particular, the provisions of:

14. Cookies and Similar Technologies

15. Limitation of Liability
With regard to limiting damages that may arise from the use of the Site, Biosmyrna reserves the mandatory provisions of the applicable legislation.
No provision may be interpreted in a way that removes Biosmyrna’s liabilities that cannot be excluded or limited by law.
Where information on the Site is used for a specific commercial transaction, technical application or decision, the user should assess that information in light of their own circumstances and, where necessary, request current information or documents from Biosmyrna.
16. Force Majeure
Where the Site cannot be used in whole or in part, or services are disrupted, due to events occurring outside Biosmyrna’s control that could not reasonably be foreseen or prevented, Biosmyrna cannot be held responsible to the extent permitted by the applicable legislation.
In this context, natural disasters, war, acts of terrorism, epidemics, decisions of public authorities, infrastructure or communication outages, large-scale cyber incidents and similar events may be taken into account where the relevant conditions arise.
17. Changes to the Terms of Use
Biosmyrna may update these Terms of Use in line with changes in the operation of the Site, its activities, the legislation or legal requirements.
The updated text applies from the date it is published on the Site, to the extent required by the applicable legislation. Where there are significant changes, the necessary notifications may also be made separately.
18. Governing Law and Competent Authorities
The laws of the Republic of Türkiye govern the interpretation and application of these Terms of Use.
Subject to the mandatory provisions of legislation on consumer transactions and the rules on jurisdiction and venue, the Turkish courts and authorities competent by law have jurisdiction to resolve disputes.
